MOTORCYCLE ACCIDENTS.

Motorcycle accidents can have grave consequences to those who are injured given the limited protection afforded to riders. 

In Ontario, the Insurance Act does not differentiate between accidents involving two motor vehicles and those involving a motor vehicle and a motorcycle. This uniform approach ensures that all parties involved in an accident are subject to the same legal and insurance processes, regardless of the type of vehicles involved.

 

Under the Insurance Act, all motor vehicle accidents are governed by the same set of rules and regulations. This includes the Statutory Accident Benefits Schedule (SABS), which provides benefits to anyone injured in a motor vehicle accident, whether they were driving a car, riding a motorcycle, or involved in any other type of motor vehicle. The benefits cover medical and rehabilitation expenses, income replacement, and other necessary supports.

Additionally, Ontario operates under a no-fault insurance system, meaning that each party’s insurance covers their own damages and injuries, regardless of who is at fault. This system applies equally to accidents involving two cars, a car and a motorcycle, or any other combination of motor vehicles.

By applying the same legal framework to all motor vehicle accidents, Ontario ensures a consistent approach to handling claims and providing benefits, promoting road safety and equitable treatment for all road users.
