Catastrophic Injuries.
A catastrophic injury can arise in cases where you or a loved one is injured in a car accident, motorcycle accident or where you are injured by a motor vehicle accident while a pedestrian. In Ontario, a catastrophic injury is one which is defined by the Statutory Accident Benefits Schedule. This means that your injuries will need to meet a certain test in order for you to be entitled to enhanced accidents benefits.
In Ontario, if you have sustained a catastrophic injury, you are entitled to enhanced benefits. You will be entitled to up to $1 million in medical, rehabilitation and attendant care benefits for the rest of your life. Furthermore, you will be able to collect a housekeeping benefit of up to $100 per week over the course of your life.
The system in Ontario to have someone designated as sustaining a catastrophic impairment is difficult in most cases. It is not uncommon for insurers to deny claims for such a designation.
