Bicycle Accidents.

Many people ride their bikes in the city to go to work, get around town or simply to enjoy a day out with friends or family.  This is not only a great way to get exercise but it is also a way to ensure that we keep our environment clean.  However, bike riding can come at a cost when injured in an automobile accident.

Cyclists can sustain injury when riding by being hit by a car or when someone opens a car door without looking.  These injuries can lead to devastating injuries despite wearing appropriate protective gear.  These types of claims require a lawyer who has experience and compassion to assist those injured in such accidents.

As a cyclist, you are entitled to Statutory Accident Benefits regardless of who is at fault. Typically, the following steps apply:

  1. Notify the Insurance Company: Inform the insurance company as soon as possible after the accident.

  2. Complete Application Forms: Fill out the necessary forms, such as the OCF-1 (Application for Accident Benefits), OCF-2 (Employer Confirmation Form), and OCF-3 (Disability Certificate).

  3. Submit Supporting Documentation: Provide any required documents, such as medical reports and police reports.

Which Insurance Company Pays?

  • Your Own Auto Insurance: If you have auto insurance, your own insurer will handle your claim.

  • Driver’s Insurance: If you don’t have auto insurance, the insurance company of the vehicle involved in the accident will cover your benefits.

  • Motor Vehicle Accident Claims Fund: If neither you nor the driver has insurance, you can apply through the Motor Vehicle Accident Claims Fund.
